CONSTRUCTION INSURANCE NORTHERN IRELAND & UK - FREQUENTLY ASKED QUESTIONS
What is Construction Insurance?
Construction Insurance Northern Ireland & UK is a broad term which covers a wide range of construction related insurance packages including Public Liability Insurance, Employers Liability Insurance, Contractors All Risks, Machinery Insurance, Personal Accident Insurance & Contract Bonds.
Construction Insurance is an extremely important consideration for construction companies due to the everyday risks involved.
What is Employers Liability Compulsory Insurance?
Employers Liability Insurance is Compulsory for Northern Ireland & UK companies once you have employees.
The law states that an employer must hold Employers Liability Compulsory Insurance [ELCI] with a minimum policy limit of £5 million however the vast majority of insurers automatically provide cover of £10 million. ELCI must cover all your employees in England, Scotland, Wales and Northern Ireland.
Are there any exceptions to the Compulsory Employers Liability Insurance requirement?
If your business is not a limited company, and you are the only employee or you only employ close family members, you do not need compulsory ELCI.
Limited companies with only one employee, where that employee also owns 50 per cent or more of the issued share capital in the company, are also exempt from compulsory ELCI.
What are the penalties for not holding Compulsory Employers Liability Insurance?
The Health & Safety Executive for Northern Ireland (HSENI) is responsible for enforcing the law on ELCI. You can be fined up to £2,500 for each day that you do not have appropriate insurance.
Generally, someone is defined as your employee if:
- you deduct National Insurance contributions and income tax from the salary you pay them
- you control when, where and how they work
- they cannot employ a substitute when they are unable to work

PUBLIC LIABILITY INSURANCE NORTHERN IRELAND & UK - FREQUENTLY ASKED QUESTIONS
What is Public Liability Insurance?
Public liability Insurance Northern Ireland & UK covers claims made against your business, if its owners, directors, employees or sub contractors are shown to be responsible for injury or damage to third parties or their property.
As we live in a society where the first call after an accident is often to a solicitor rather than the hospital, public liability insurance Northern Ireland & UK is something all businesses need to take very seriously as part of their business insurance Northern Ireland & UK package.
Consider the following examples where Public Liability Insurance will provide cover:
- You run a plumbing company. One day you are called to an office to sort out a problem in their kitchen. Accidentally, you burst a pipe, and flood the office. Your client then makes a claim against you for the damage to their carpet and computer systems which have been damaged by the water.
- You are a building contractor. While walking along scaffolding one of your employees drops a piece of equipment which falls to the street, injuring a passing pedestrian. The pedestrian makes a claim against your firm.
Why is Public Liability Insurance Northern Ireland so Important for Irish Contractors?
For the Construction Industry, Public Liability Insurance Northern Ireland in today's litigious society is more important than ever. As a construction contractor in Northern Ireland & UK, it is essential that your business holds public liability insurance as your business activities mean that you can be sued by the public for your negligence. Although the ‘claims culture’ in Northern Ireland is not as rampant as in the USA, more and more people, instead of accepting that loss or damage can happen by accident, are encouraged to believe that it must have been through someone's negligence - with the result that they sue hence the need for Public Liability Insurance Northern Ireland & UK. In particular, the arrival & growth of 'no-win no-fee' agreements and legal expenses cover has meant that access to the courts has never been easier. This ease of access, together with the perception that judges will award compensation in virtually every case has resulted in the growth of Public Liability claims in the last decade.
