What is Construction Insurance?
Construction Insurance is a broad term which covers a wide range of construction related insurance packages including Public Liability Insurance, Employers Liability Insurance, Contractors All Risks, Machinery Insurance, Personal Accident Insurance & Contract Bonds.
Construction Insurance is an extremely important consideration for construction companies due to the everyday risks involved.
What is Employers Liability Compulsory Insurance?
Employers Liability Insurance is Compulsory for Northern Ireland & UK companies once you have employees.
The law states that an employer must hold Employers Liability Compulsory Insurance [ELCI] with a minimum policy limit of £5 million however the vast majority of insurers automatically provide cover of £10 million. ELCI must cover all your employees in England, Scotland, Wales and Northern Ireland.
Are there any exceptions to the Compulsory Employers Liability Insurance requirement?
If your business is not a limited company, and you are the only employee or you only employ close family members, you do not need compulsory ELCI.
Limited companies with only one employee, where that employee also owns 50 per cent or more of the issued share capital in the company, are also exempt from compulsory ELCI.
What are the penalties for not holding Compulsory Employers Liability Insurance?
The Health & Safety Executive for Northern Ireland (HSENI) is responsible for enforcing the law on ELCI. You can be fined up to £2,500 for each day that you do not have appropriate insurance.
Generally, someone is defined as your employee if:
- you deduct National Insurance contributions and income tax from the salary you pay them
- you control when, where and how they work
- they cannot employ a substitute when they are unable to work
Is Construction Insurance expensive?
The cost varies depending on a number of factors such as occupation, number of employees, turnover, claims history etc but overall the cost of construction insurance has fallen dramatically in recent years.
